IHC issues notices to PTA & Federal Government in another petition against social media rules

Islamabad, 21st December 2020: The Islamabad High Court on Monday issued notices to the Pakistan Telecommunication Authority (PTA) and the Federal Government in a case filed by journalist Amber Rahim Shamsi against the Removal and Blocking of Unlawful Content (Procedure, Oversight and Safeguards), Rules 2020. 

The petition, filed on 17th December, challenges the Rules notified under Section 37 of the Prevention of Electronic Crimes Act, 2016, demanding the Court to declare them as ultra vires and that PTAå be stopped from illegally and arbitrarily blocking online content. 

The petition discusses how the Rules violate the fundamental right to freedom of expression and right to access to information laid down by the Constitution through Article 19 and 19-A. It also raises concerns on PTA’s failure to conduct an effective and meaningful consultation with all the stakeholders involved with regards to the Rules.

The case was adjourned for hearing until the 25th of January, when it will be taken up alongside a similar petition filed by Pakistan Federal Union of Journalists (PFUJ) against the Rules, and a contempt petition filed against PTA by Awami Workers Party. 

سلام آباد ہائیکورٹ کے چیف جسٹس اطہرمن اللہ کی عدالت نے سوشل میڈیا کے نئے قواعد کے خلاف ایک اور درخواست پر بھی پی ٹی اے کوجواب کیلئےنوٹس جاری کرتے ہوئے اس کیس کو بھی دوسری درخواستوں کے ساتھ منسلک کرنے کی ہدایت کردی۔

درخواست گزار امبررحیم شمسی کی جانب سے 13 رولز اور پاکستان الیکٹرانک کرائم ایکٹ کی سیکشن 37 ون کے خلاف درخواست پر سماعت کے دوران استدعاکی گئی کہ پی ٹی اے کو غیر قانونی طور پر مختلف ایپلیکشنز پر پابندی لگانے سے روکا جائے،۔ سوشل میڈیا رولز کے خلاف مرکزی درخواستیں 25 جنوری کو سماعت کے لیے مقرر ہیں۔ عوامی ورکرز پارٹی اور پی ایف یو جے نے اسلام آباد ہائیکورٹ میں پہلے ہی پی ٹی اے رُولز کیخلاف درخواستیں دائر کر رکھی ہیں۔ درخواست گزاروں کا موقف ہے کہ پی ٹی اے کی جانب سے بنائے گئے رُولز آئین کے آرٹیکل انیس کی خلاف ورزی ہیں جبکہ پی ٹی اے نے رُولز بناتے وقت تمام فریقین سے مشاورت بھی مکمل نہیں کی ۔؟
