The Removal and Blocking of Unlawful Online Content Rules 2020 – Legal Analysis

The Removal and Blocking of Unlawful Online Content (Procedure, Oversight and Safeguards) Rules 2020 have been drafted under Section 37 of Prevention of Electronic Crimes Act 2016 (referred to as PECA from hereafter). 

The rules were notified in October 2020, and published in the Official Gazette in November. A small amendment was made in the Rules, on 27th November though a corrigendum that was published in the official gazette. 

MMfD published a preliminary analysis of the rules in November 2020.

This is a detailed legal analysis of the Rules, that have now been challenged by various petitions in Islamabad High Court.
